§6–608.
(a)In this section, “officer” includes a superintendent, a manager, or an agent of a business entity, regardless of whether the business entity engages in the business of providing electrical services.
(b)Any person, including an officer, who violates any provision of this subtitle is guilty of a misdemeanor and on conviction is subject to:
(1)on a first conviction, a fine not exceeding $1,000; and
(2)on a second or subsequent conviction, a fine not exceeding $5,000.
(c)Any person who violates § 6–604 of this subtitle is guilty of a misdemeanor and on conviction is subject to a fine not exceeding $1,000.
(1)In addition to any other penalties imposed under this title, the State Board may impose on a person who violates any provision of this subtitle a civil penalty not exceeding $5,000 for each violation.
(2)In determining the penalty imposed under paragraph
(1)of this subsection, the State Board shall consider:
(i)the seriousness of the violation;
(ii)the good faith of the violator;
(iii)any previous violations by the violator;
(iv)the harmful effect of the violation; and
(v)any other relevant factors.
(e)The State Board shall pay any penalty collected under subsection
(d)of this section into the General Fund of the State.
