§202. Louisiana Bicycle and Pedestrian Safety Dedicated Fund Account
A. There is hereby created, as a special account in the state treasury, the Louisiana Bicycle and Pedestrian Safety Dedicated Fund Account, to be referred to as the account. The source of monies for the account shall be that portion of the monies derived from fees imposed and dedicated to the account pursuant to the provisions of R.S. 47:463.148, and grants, gifts, and donations and any other monies received by the state for the purposes of bicycle and pedestrian safety and which are appropriated to the account.
B. After compliance with the requirements of Article VII, Section 9(B) of the Constitution of Louisiana, relative to the Bond Security and Redemption Fund, an amount equal to that deposited into the state treasury from the foregoing sources shall be deposited in and credited to a special agency account. Funding deposited into the account shall be considered fees and self-generated revenues and shall be available for annual appropriations by the legislature.
C. Monies in the account shall be subject to annual appropriation by the legislature for use by the Department of Transportation and Development. The monies in the account shall be allocated and disbursed by the secretary of the Department of Transportation and Development and used solely for bicycle and pedestrian safety.
