76.246 Notice of hearing, publication -- Order of construction and assessment.

(1)When the report described in KRS 76.243 is prepared, a copy shall be filed with the
secretary-treasurer of the district who shall, within forty
(40)days, cause notice of
the filing of same and a notice of where the report is available for public inspection
to be published pursuant to KRS Chapter 424. The notices shall state the time, date
and place for a public hearing on the report. Any affected property owner may
appear at the hearing. The district may appoint a hearing officer to conduct hearings,
take testimony, and report the hearing to the district board.
(2)Following the hearing the district shall make and publish an order describing the
construction plan in general, setting forth the assessment method adopted, if any,
the parcels assessed, provisions if any for application of KRS 107.140 (d), which
relates to doing equity with respect to persons paying immediately and those who
may be assessed later for extensions, and any other matters the district may see fit to
include in the order.
