(1)Notwithstanding the provisions of KRS 49.340, if it appears to the Crime Victims
Compensation Board member to whom a claim is assigned, prior to taking action
upon the claim, that:
(a)The claim is one with respect to which an award probably will be made; and
(b)Undue hardship will result to the claimant if immediate payment is not made;
emergency payment under subsection
(2)of this section may be made.
(2)Upon findings under subsection
(1)of this section, the board member may make an
emergency award to the claimant pending a final decision in the case provided that:
(a)The amount of an emergency award shall not exceed one thousand dollars
($1,000);
(b)The amount of an emergency award shall be deducted from any final award
made to the claimant; and
(c)The excess of the amount of an emergency award over the amount of the final
award, or the full amount of the emergency award if no final award is made,
shall be repaid by the claimant to the board.
(3)A decision to make an emergency award pursuant to this section shall be made
within two
(2)weeks of the receipt of the claim by the Crime Victims
Compensation Board.
