353.591 Purpose and application of KRS 353.592 and 353.593.

The purpose of KRS 353.592 and 353.593 shall be, upon delegation of authority for administration of the Underground Injection Control Program under Section 1425 of the Safe Drinking Water Act (Public Law 93-523 as amended), to protect underground sources of drinking water and to prevent their endangerment from class II wells. KRS 353.592 and 353.593 shall apply to all persons as defined in KRS 353.510; to all lands including federally-owned lands; and to all class II wells without regard to the time the well was drilled; provided that the department may make reasonable distinctions between existing and new class II wells in the implementation of KRS 353.592 and 353.593.
No provision of KRS 353.592 or 353.593 shall apply to crude oil or natural gas production wells that are not class II wells.
