353.205 Department to release production data on crude oil and natural gas.

(1)The Department of Revenue shall submit to the department on or before September
1 of each year, beginning in 1995 for 1994 production data, statistics on crude oil as
reported to the Department of Revenue under the crude oil excise tax requirements
of KRS Chapter 137 and statistics on natural gas production as reported to the
Department of Revenue under the natural resources severance tax requirements of
KRS Chapter 143A.
(2)The department shall organize the information it receives from the Department of
Revenue into a standard format, and shall make it available for public release no
earlier than January 1 nor later than March 1 of the following year, with the
exception of the first year, when data shall be made available by September 1, 1996.
The information shall be open for public inspection and available for sale at the
offices of the department. The department may allow the Kentucky Geological
Survey to use the production information in ongoing research as soon as it is
obtained from the Department of Revenue, so long as the information is not
released to the public before January 1 of the year after it is reported.
(3)The Department of Revenue shall submit to the department the oil and gas
production data which was reported in years prior to 1995, and the department shall
make this information available for public release when it has been processed.
