338.133 Injunction to restrain operation of unsafe premises or equipment.

(1)If in the discretion of the commissioner it is believed that a place of employment,
equipment, or practice is substantially dangerous to employees, or other persons,
then the commissioner may apply to the Circuit Court in the county wherein the
condition is located for a temporary injunction restraining the operation or segment
of operation.
(2)The Circuit Court shall hear the application for the temporary injunction as soon as
possible, irrespective of the regular court calendar.
(3)The commissioner shall not be required to post any bond or pay any court costs or
fees with the filing of the application.
