338.111 Employer and employee representation.

(1)Representatives of the employer shall be given the opportunity to accompany the
commissioner or the authorized representative of the commissioner during the
physical inspection of any place of employment as authorized by KRS 338.101.
(2)A representative authorized by the employees shall be given an opportunity to
accompany the representative of the commissioner during the physical inspection of
any place of employment related to occupational safety and health as authorized by
KRS 338.101. If there is no representative authorized by the employees available at
the time of the physical inspection, the commissioner's representative shall consult
with a reasonable number of employees concerning matters related to occupational
safety and health in the place of employment.
(3)The representative of the commissioner shall be responsible for the conduct of the
inspection and may limit the number of representatives on the inspection team.
