321.990 Penalties.

(1)Any person who violates or aids in the violation of KRS 321.190, 321.201,
321.207, 321.236, 321.441, or 321.443 for practicing or for performing services
without a credential required by the board shall be guilty of a misdemeanor upon
conviction in court, and shall be sentenced to jail for not less than ten
(10)days nor
more that ninety
(90)days per violation.
(2)Any person exercising or attempting to exercise control over, interfering with, or
attempting to influence the professional judgment of a credential holder in any
manner, including through coercion, collusion, extortion, inducement, or
intimidation, shall be guilty of a misdemeanor upon conviction in court, and shall
be sentenced to jail for not less than ten
(10)days nor more that ninety
(90)days
per violation.
(3)Any person who resists, obstructs, interferes with, threatens, attempts to intimidate,
or in any other manner interferes with an agent of the board or who willfully refuses
to obey their lawful orders shall be guilty of a misdemeanor upon conviction in
court, and shall be sentenced to jail for not more than thirty
(30)days for each
offense.
(4)Each day or part of a day that a violation continues is a separate violation and
subject to daily penalties.
(5)Nothing in this section shall limit, preclude, or supersede the board's power to:
(a)Impose fines for a violation of this chapter or any administrative regulations
promulgated under this chapter;
(b)Deny, restrict, or revoke a license issued under this chapter or administrative
regulations promulgated under this chapter; and
(c)Impose any other form of discipline based on a conviction under this section
or as otherwise authorized by this chapter or administrative regulations
promulgated under this chapter.
