If the violation of any section of this chapter or regulation promulgated thereunder is committed in the presence of the officer, the officer may, in lieu of making a physical arrest, issue a citation requiring the defendant to appear before the District Court of the county in which the offense occurred at a future time to be stated in the citation. In no event shall the citation state a time of appearance in excess of ten
(10)days from the date the citation was issued.
