75A.090 Contracts between district and fire units or districts, municipal

corporations, rescue squads, and others, for fire protection -- Deemed
governmental functions.
(1)The district may, through the board, make and enter into contracts with any other
fire protection district, fire prevention district, municipal corporation, volunteer fire
department, volunteer fire prevention unit, volunteer fire protection unit, any special
district whose services are subject to the licensure provisions of KRS Chapter
311A, or any rescue squads established under KRS Chapter 39F, either within the
same county or within an adjoining county in an area adjacent to the boundary line
between the counties, for the furnishing or receiving of emergency services for all
property within the confines of the area included in and covered by the contract or
contracts, where these emergency services are not otherwise provided by some
division of government or governmental agency.
(2)The personnel acting in their official capacities and equipment of a contracting
party, in going to and returning from an emergency, or in answering and responding
to a false alarm or call, and while endeavoring to provide emergency services within
the area covered by the contract, shall be deemed and is declared to be engaged in
the exercise of a governmental function.
