programs -- Transfer of juveniles to Department of Corrections facilities.
(1)The Department of Juvenile Justice shall operate or contract for the operation of any
postadjudication juvenile detention or treatment facility in which a juvenile is
confined for a public offense or as a youthful offender.
(2)Not less than one
(1)facility specified in subsection
(1)of this section shall be a
secure facility with a security level comparable to a medium-security adult facility.
(3)The Department of Juvenile Justice shall operate or contract for the operation of any
postadjudication juvenile treatment, rehabilitation, probation, or parole programs,
diversion or alternatives to secure detention programs, or other programs for
juvenile offenders to which a juvenile committed as a public offender or sentenced
as a youthful offender has been assigned.
(4)A juvenile detained in a department-operated postadjudication detention or
treatment facility may be transferred to a Department of Corrections facility at any
time as provided by KRS 640.070 or other specific statute.
