report.
(1)Any boiler inspector's, special inspector's, owner-user inspector's, or owner's piping
inspector's appointment or commission may be suspended or revoked by the
department, after due investigation and hearing thereon, for the incompetence or
untrustworthiness of the holder thereof, or for willful falsification of any matter or
statement contained in his or her application or in a report of any inspection made
by him or her. Written notice of and an opportunity for a hearing on any suspension
or revocation under this subsection shall be given by the department to the
inspector, and in the case of a special boiler inspector, also to his or her employer in
accordance with the provisions of KRS Chapter 13B.
(2)A person whose appointment or commission has been suspended shall be entitled to
apply to the commissioner, after ninety
(90)days from the date of the suspension,
for reinstatement of the appointment or commission.
(3)Any willful falsification of an application or inspection report shall constitute a
misdemeanor and shall subject the inspector or special inspector to the penalties
provided in KRS 236.990.
