213.174 Report forms -- Annual statistical report -- Public records --

Confidentiality of identity -- Communication of reporting requirements.
(1)The cabinet shall create and distribute the report forms required in KRS
213.101, 213.172, 311.732, 311.7735, 311.7736, 311.774, 311.7741, and
311.783 within sixty
(60)days after April 14, 2022.
(2)The cabinet shall prepare and submit a comprehensive annual statistical report
to the General Assembly based upon the data gathered from reports required
in KRS 213.101, 213.172, 311.732, 311.7735, 311.7736, 311.774, 311.7741,
and 311.783. The aggregated data shall also be made available to the public
by the cabinet in an electronic format.
(3)Reports required in KRS 213.101, 213.172, 311.732, 311.7735, 311.7736,
311.774, 311.7741, and 311.783 shall be deemed public records and shall be
provided by the cabinet to the Kentucky Board of Medical Licensure, the
Kentucky Board of Pharmacy, state law enforcement offices, and child
protective services upon request for use in the performance of their official
duties.
(4)Absent a valid court order or judicial subpoena, the cabinet, and any other
state department, agency, or office or any employees thereof, shall not
compare data concerning drug-induced abortion or drug-induced abortion
complications or adverse events as defined in KRS 311.7731 maintained in an
electronic or other information system file with data in any other electronic or
other information system, the comparison of which could result in identifying, in
any manner or under any circumstances, a pregnant patient who is obtaining or
seeking to obtain a drug-induced abortion.
(5)Statistical information that may reveal the identity of a pregnant person
obtaining or seeking to obtain a drug-induced abortion shall not be maintained
by the cabinet or any other state department, agency, or office, or any
employee or contractor thereof.
(6)The cabinet shall communicate the reporting requirements in KRS 213.101,
213.172, 311.732, 311.7735, 311.7736, 311.774, 311.7741, and 311.783 to all
medical professional organizations, licensed physicians, hospitals, emergency
medical service providers, abortion facilities, ambulatory surgical facilities,
pharmacies, and other healthcare facilities operating in Kentucky.
