(1)No later than October 1 of each year, each institution shall submit a certified report
to the Legislative Research Commission for referral to the appropriate Interim Joint
Committee on Education, and shall publish the report to a prominent, publicly
accessible location on the institution's website. Each report shall be certified by the
institution's general counsel and contain a complete list and description of the
nature, costs, and source of authority of all policies, programs, practices, and
procedures of the institution that are:
(a)Designed or implemented to promote or provide differential treatment or
benefits to individuals on the basis of religion, race, sex, color, or national
origin; and
(b)Required pursuant to any applicable federal or state law, a court order, or a
binding contract entered into prior to June 27, 2025.
(2)An institution shall not claim, assert, or rely upon a governmental mandate as a
defense to a civil action filed by the Attorney General under KRS 164.2895(6)
unless that mandate was listed and clearly and accurately described in:
(a)The institution's most recent annual report required by subsection
(1)of this
section prior to the date the events or omissions giving rise to the civil action
occurred; or
(b)An addendum to the institution's most recent annual report required by
subsection
(1)of this section that was published:
1. Prior to the date the events or omissions giving rise to the civil action
occurred; and
2. In the same location on the institution's website as the report required by
subsection
(1)of this section.
(3)This section shall expire on and have no force or effect after June 30, 2031, unless
extended by an act of the General Assembly.
