80-1522. Purchase of fire-fighting apparatus by certain townships; resolution; bonds; election; tax levies. When any township has joined with a city in maintaining a fire department under the provisions of K.S.A. 80-1501 , or when any township has entered into a contract with a city whereby such city agrees to furnish fire-fighting service to the township under the provisions of K.S.A. 80-1502 , and the fire-fighting apparatus of the joint department or the fire-fighting apparatus of the city in the case of the contract for service is inadequate properly to service both the city and the township, the township board may adopt a resolution describing the situation which exists and the advisability of acquiring additional fire-fighting apparatus and providing for the submission to the qualified electors of the township who reside outside of the corporate limits of such city at a general election or special election the question of voting bonds for fire-fighting apparatus.
Notice of the election shall be as provided by the general bond law, and the election conducted as therein provided. At such election the question on the ballot shall be stated substantially as follows: "Shall ______________ township in ______________ county, Kansas, issue bonds under the provisions of (citing this act) in a sum not exceeding ______________ dollars ($________) for the purpose of purchasing fire-fighting apparatus?" The judges of the election shall have the power to determine the residence qualifications of voters under this act.
If a majority of those voting on the question shall vote in favor thereof the township board shall have authority to issue the bonds in the manner provided by law and purchase the fire-fighting apparatus. Such bonds shall be issued to mature in not more than ten
(10)installments of approximately equal amounts each year and the last installment shall mature not more than eleven
(11)years after the date of issuance. The tax levies to pay such bonds and the interest thereon shall apply to the taxable tangible property in the township outside of such city.
