Sec. 211. The Department, taking into consideration the recommendations of its Prescription Monitoring Program Advisory Committee, may issue a rule scheduling a substance in Schedule V if it finds that:
(1)the substance has low potential for misuse relative to the controlled substances
listed in Schedule IV;
(2)the substance has currently accepted medical use in treatment in the United States;
and
(3)misuse of the substance may lead to limited physiological dependence or
psychological dependence relative to the substances in Schedule IV, or the substance is a targeted methamphetamine precursor as defined in the Methamphetamine Precursor Control Act.
