Sec. 80. Antitrust. Producers or battery stewardship organizations acting on behalf of producers that prepare, submit, and implement a battery stewardship program plan under this Act and who are thereby subject to regulation by the Agency are granted immunity from State laws relating to antitrust, restraint of trade, unfair trade practices, and other regulation of trade and commerce, for the limited purpose of planning, reporting, and operating a battery stewardship program, including:
(1)the creation, implementation, or management of a battery stewardship organization
and any battery stewardship plan regardless of whether it is submitted, denied, or approved;
(2)the determination of the cost and structure of a battery stewardship plan; and
(3)the types or quantities of batteries being recycled or otherwise managed under this
Act.
