Sec. 3. Duties of Departments of Healthcare and Family Services and Public Health.
(A)The Department of Healthcare and Family Services shall:
(a)Develop standards for determining eligibility for care and treatment under this
program. Among other standards so developed under this paragraph, candidates, to be eligible for care and treatment, must be evaluated in a center properly staffed and equipped for such evaluation.
(b)(Blank).

(d)Extend financial assistance to persons suffering from chronic renal diseases in
obtaining:
(1)Treatment in a dialysis facility;
(2)Hospital treatment for dialysis and transplant surgery;
(3)Treatment in a limited care facility;
(4)Home dialysis training; and
(5)Home dialysis.
(e)(Blank).
(f)On and after July 1, 2012, the Department shall reduce any rate of reimbursement for
services or other payments or alter any methodologies authorized by this Act or the Illinois Public Aid Code to reduce any rate of reimbursement for services or other payments in accordance with Section 5-5e of the Illinois Public Aid Code.
Effective January 1, 2014, coverage under this Act shall be coordinated with the requirements of the Patient Protection and Affordable Care Act and eligibility under this Act shall be available only to individuals who have met their obligations under the Patient Protection and Affordable Care Act to obtain health insurance. For purposes of this Act, payment of a tax penalty for failing to obtain insurance is not considered fulfilling the obligation to obtain health insurance under the Patient Protection and Affordable Care Act. Coverage of the services listed in paragraph
(d)of this subsection shall be coordinated with the individual's health insurance plan.
The Department of Healthcare and Family Services, the Department of Human Services, and the Illinois health insurance marketplace shall work cooperatively to assist persons enrolled for services under this Act to obtain health insurance coverage prior to January 1, 2014.
(B)The Department of Public Health shall:
(a)Assist in the development and expansion of programs for the care and treatment of
persons suffering from chronic renal diseases, including dialysis and other medical or surgical procedures and techniques that will have a lifesaving effect in the care and treatment of persons suffering from these diseases.
(b)Assist in the development of programs for the prevention of chronic renal diseases.
(c)Institute and carry on an educational program among physicians, hospitals, public
health departments, and the public concerning chronic renal diseases, including the dissemination of information and the conducting of educational programs concerning the prevention of chronic renal diseases and the methods for the care and treatment of persons suffering from these diseases.
