Sec. 5. Powers and duties of the Department. The Department shall exercise, subject to the provisions of this Act, the following functions, powers, and duties:

(a)Authorize examinations to ascertain the fitness and qualifications of applicants for

licensure and pass upon the qualifications and fitness of applicants for licensure by endorsement.

(b)Adopt rules required for the administration of this Act.

(c)Conduct hearings on proceedings to refuse to issue or renew, restore, revoke, or

suspend licenses or place on probation or reprimand persons or entities licensed under the provisions of this Act.

(d)Issue licenses to those who meet the requirements of this Act.

(e)Adopt rules as to what shall constitute a professional engineering or related

science curriculum.

(f)Adopt rules for what constitutes professional engineering experience.

(g)Maintain membership in the National Council of Examiners for Engineering and

Surveying and participate in activities of the Council by designation of individuals for the various classifications of membership, the appointment of delegates for attendance at zone and national meetings of the Council, and the funding of the delegates for attendance at the meetings of the Council.

(h)Adopt rules for standards of professional conduct.

(i)Obtain written recommendations from the Board regarding qualifications of

individuals for licensure and enrollment, definitions of curriculum content and approval of engineering curricula, standards of professional conduct and formal disciplinary actions, and the adoption of the rules affecting these matters.

Upon the issuance of any final decision or order that deviates from any report or

recommendation of the Board relating to the qualification of applicants, discipline of licensees or registrants, or adoption of rules, the Secretary shall notify the Board on any such deviation and shall specify with particularity the reasons for the action in the final decision or order. The Department may at any time seek the expert advice and knowledge of the Board on any matter relating to the enforcement of this Act.

(i)Post on the Department's website, a newsletter describing the most recent changes in

this Act and the rules adopted under this Act and containing information of any final disciplinary action that has been ordered under this Act since the date of the last newsletter.

(j)Review such applicant qualifications to sit for the examination or for licensure as

the Board designates pursuant to Section 7 of this Act.

(k)Conduct investigations related to possible violations of this Act.
