357.7 Water source without district.

1. If it is anticipated that the source of water supply will be outside of and not under control of any proposed benefited water district, the board of supervisors shall instruct the engineer who is appointed under section 357.6 to make the preliminary design and dummy assessment to also obtain a written statement from the corporation or municipality which controls the proposed source of supply outlining the terms upon which water will be furnished to the district or to the individuals within the district.
2. This preliminary proposal from the governing body of the source of supply shall be binding and shall be in the nature of an option to purchase water by the district, or individuals within the district, if and when the proposed benefited water district completes its construction and is ready to use water. This proposal shall accompany and be a part of the engineer’s preliminary report to the board of supervisors.
