If a patient is not receiving medical assistance under chapter 249A and the amount in the account of any patient in the patients’ personal deposit fund exceeds two hundred dollars, the department may apply any amount of the excess to reimburse the state for liability incurred by the state for the payment of care, support, and maintenance of the patient when billed by the state.
