(a)The department shall consult with the Hawaii tourism authority and state foundation on culture and the arts to identify sites in the State that were significant in the life of President Barack Obama, the forty-fourth President of the United States of America, and determine appropriate locations for historical markers to indicate these significant sites.

(b)The department shall place historical markers at the locations identified pursuant to subsection (a); provided that:

(1)If the location identified for a historical marker is on privately owned property, the historical marker shall only be placed if the property owner agrees to have the marker placed at that location;

(2)If an owner of private property does not agree to have a marker placed on the owner's property, the marker may be placed on public property in close proximity to that location; and

(3)If the location identified for a historical marker is a private residence, the historical marker shall be placed only if the owner agrees to have a historical marker placed either at the residence or on public property in close proximity to that location. [L 2022, c 210, §1]
