The Secretary of the State shall not issue a registration to, or file any documents submitted by, any foreign statutory trust unless
(1)such foreign statutory trust's name complies with the provisions of section 34-506 ; or
(2)the foreign statutory trust adds to its name in its application for registration to transact business in this state, and agrees in such application to use in this state, exclusive of any other name, a distinctive and distinguishing element, which in the judgment of the Secretary of the State will be sufficient to distinguish its name upon the records of the Secretary of the State, in the manner required by subsection
(a)of section 34-506 ; or
(3)the foreign statutory trust has obtained permission to use in this state a name that does not otherwise meet the requirements of subsection
(a)of section 34-506 in the form of a written consent, executed and filed as provided in section 34-504 , from each person or statutory trust which has reserved or is properly using in this state a name that is not such as can be distinguished from the name of the foreign statutory trust and agrees in such application to use in this state exclusive of any other name, a distinctive and distinguishing element, which in the judgment of the Secretary of the State will be sufficient to distinguish its name, upon the records of the Secretary of the State, in the manner required by subsection
(a)of section 34-506 ; or
(4)the foreign statutory trust chooses to transact business in this state using a name that is different from the name under which it is organized and such name complies with section 34-506 .
