Any person who wilfully injures any oyster enclosure legally designated, marked out and enclosed or removes any buoys or stakes used to mark out any oyster ground, or who takes any shells from such enclosure, shall
(1)for a first offense, be fined not more than two hundred fifty dollars, and
(2)for any subsequent offense, be guilty of a class C misdemeanor.
