§ 14188.2

(a)The VBP programs described in Section 14188.1 shall be funded using moneys appropriated to the department for purposes of those programs in the Budget Act of 2019, or a Budget Act in a subsequent fiscal year, from the Healthcare Treatment Fund established pursuant to subdivision
(a)of Section 30130.55 of the Revenue and Taxation Code.
(b)The Legislature finds and declares that the expenditures authorized by this article are all of the following:
(1)Made in accordance with the California Healthcare, Research and Prevention Tobacco Tax Act of 2016 (Article 2.5 (commencing with Section 30130.50) of Chapter 2 of Part 13 of Division 2 of the Revenue and Taxation Code).
(2)Based on criteria developed and periodically updated as part of the annual state budget process, in accordance with subdivision
(a)of Section 30130.55 of the Revenue and Taxation Code.
(3)Consistent with the purposes and conditions of expenditures described in subdivision
(a)of Section 30130.55 of the Revenue and Taxation Code.
