(a)The criminal history check required by this section is limited to a State Department of Social Services employee, prospective employee, contractor, subcontractor, and volunteer whose duties include, or would include, access to any of the following:
(1)Criminal offender record information, as defined in Section 11075 of the Penal Code.
(2)Federal tax information, as defined in paragraph
(1)of subdivision
(f)of Section 1044 of the Government Code.
(3)Individuals who reside in, receive care from, or are sheltered in a facility licensed or otherwise administered by the department; individuals who receive child welfare services overseen by the department; and other individuals served by the department, as defined by law.
(b)Pursuant to subdivision
(u)of Section 11105 of the Penal Code, the State Department of Social Services shall submit to the Department of Justice fingerprint images and related information required by the Department of Justice for all employees, prospective employees, contractors, subcontractors, and volunteers specified in subdivision (a). The Department of Justice shall provide a state- or federal-level response pursuant to subdivision
(p)of Section 11105 of the Penal Code.
