(a)Notwithstanding Section 117070 or 117120 of the Health and Safety Code, any violation of a rule or regulation of a district adopted pursuant to Section 117060 or 117105 of the Health and Safety Code shall be a misdemeanor unless the district by ordinance declares the violations to be an infraction.
(b)Every violation declared an infraction pursuant to subdivision
(a)shall be punishable by
(1)a fine not exceeding fifty dollars ($50) for a first violation;
(2)a fine not exceeding one hundred dollars ($100) for a second violation of the same ordinance within one year; and
(3)a fine not exceeding two hundred fifty dollars ($250) for each additional violation of the same ordinance within one year.
