§ 52166

All teachers and aides providing instruction in programs established pursuant to subdivision (a), (b), or, unless waived by the board,
(c)of Section 52163, shall meet the criteria of subdivision
(h)or
(i)of Section 52163. In the event a school operates an individualized program described in subdivision
(e)or
(f)of Section 52163, such a district which receives categorical aid funds to meet the needs of pupils of limited English proficiency shall certify to the board that sufficient teachers and aides meeting the criteria of subdivision
(h)or
(i)of Section 52163, as appropriate, are available to the school to ensure that all pupils of limited English proficiency have instructional opportunities in both English and their primary language to meet the intent of this chapter. Other instructional personnel who are not bilingual-crosscultural as defined in subdivisions
(h)and
(i)of Section 52163 may provide instructional and educational services to pupils enrolled in programs established pursuant to subdivision (a), (b), or
(c)of Section 52163 if the principal teachers and aides providing instruction in such programs meet the criteria established in subdivisions (h), unless waived by the board pursuant to subparagraph
(B)of paragraph
(1)of subdivision
(c)of Section 52163, and
(i)of Section 52163.
In the development of teacher evaluation procedures pursuant to Article 11 (commencing with Section 44660) of Chapter 1 of Part 25, the governing board of each school district may ensure that a teacher meeting the criteria of subdivision
(h)of Section 52163 is evaluated on the basis of his or her classroom performance by an onsite administrator upon the advice of another person meeting the criteria of subdivision
(h)of Section 52163.
