(a)The department may issue a special temporary off-sale wine license
(1)to an executor, administrator, guardian or conservator of an estate, or to an auctioneer acting as an agent of any of the foregoing for the purpose of conducting a sale or auction of bottled wine to nonlicensees pursuant to Section 23104.4, or
(2)to a sheriff or a person appointed by the court to execute a court order or writ of execution, for the purpose of conducting a sale of bottled wine to nonlicensees pursuant to Section 23104.5. An applicant for such a license shall accompany the application with a fee of one hundred dollars ($100).
(b)Such a license shall only entitle the licensee to sell or auction bottled wine included in the inventory of alcoholic beverages.
(c)Such a license shall be for the period required to dispose of the bottled wine to be sold or auctioned, or until the closing of the estate or execution of the court order or writ of execution, whichever occurs first.
(d)The department shall adopt such rules as it determines to be necessary to implement and administer the provisions of this section.
