In this section, the term covered point of order means a point of order— under the Congressional Budget Act of 1974 (2 U.S.C. 621 et seq.), the Balanced Budget and Emergency Deficit Control Act of 1985 (2 U.S.C. 900 et seq.), or a concurrent resolution on the budget; and which, but for subsection (b), may be waived only by the affirmative vote of two-thirds of the Members of the Senate, duly chosen and sworn. In the Senate— a covered point of order may be waived only by the affirmative vote of two-thirds of the Members, duly chosen and sworn; and an affirmative vote of two-thirds of the Members, duly chosen and sworn, shall be required to sustain an appeal of the ruling of the Chair on a covered point of order.
