The Secretary of Commerce shall take such actions as may be necessary to ensure no duplication of activities carried out under this subtitle with the activities of— research entities of the Department of Energy, including— the National Laboratories; and the Advanced Scientific Computing Research program; and relevant industries. Any advanced computing resources, testbeds, expertise, or other resources of the Department of Energy or the National Laboratories that are provided to the National Science Foundation, the National Institute of Standards and Technology, or any other applicable entities under this subtitle shall be provided— on a reimbursable basis; and pursuant to a reimbursable agreement.
The Secretary may waive the requirements set forth in subsection
(b)if the Secretary determines the waiver is necessary or appropriate to carry out the missions of the Department of Commerce. Nothing in this subtitle shall be construed— to modify any requirement or authority provided under section 5501 of the National Artificial Intelligence Initiative Act of 2020 ( 15 U.S.C. 9461 ); or to allow the Secretary of Commerce (including the Under Secretary of Commerce for Standards and Technology or the Director of the Center for Artificial Intelligence Standards and Innovation) or the Director of the National Science Foundation to use monetary resources of the Department of Energy or any National Laboratory.
