Section 1001 of title 18, United States Code, is amended by adding at the end the following: In this subsection, the terms Federal welfare program and noncitizen have the meanings given such terms in section 4 of the Welfare Fraud Deterrence and Recovery Act of 2026 . If a person violates subsection
(a)with respect to a matter that relates to a Federal welfare program— the term of imprisonment imposed under this section shall be not more than 15 years; if the defendant is a noncitizen or a naturalized citizen of the United States, the term of imprisonment imposed under this section shall be not less than 2 years; and if the defendant obtained not less than $100,000 as a result of the conduct in violation of this section, the term of imprisonment imposed under this section shall be not less than 5 years. .
