Not later than 2 years after the date of enactment of this Act, the Secretary shall— review— the definition of confirmed discovery used by the Administration for purposes of the reporting of accidents and incidents to the National Response Center and the Secretary (including any regulations promulgated under section 9 of the Pipeline Safety, Regulatory Certainty, and Job Creation Act of 2011 ( 49 U.S.C. 60117 note; Public Law 112–90 )), establishing communication with first responders and other relevant public officials as described in section 60102(r)(1) of title 49, United States Code, providing immediate notice to the National Response Center as described in section 191.5 and 195.52 of title 49, Code of Federal Regulations (or any successor regulations), and any other relevant purposes; and for each initial notice of an accident or incident submitted to the National Response Center telephonically or electronically under section 191.5 or 195.52 of title 49, Code of Federal Regulations, during the 5-year period ending on the date of enactment of this Act— the time between the first signs of an accident or incident and the time at which operators determined that the accident or incident met the definition of confirmed discovery; the methods that operators used to confirm that an accident or incident met that definition; and the time that it took for operators to report an accident or incident after confirming that the accident or incident met that definition; and submit to the appropriate committees of Congress a report that provides the findings of the review under paragraph (1), including the details described in subparagraph
(B)of that paragraph for each accident or incident. Section 60122(b)(1) of title 49, United States Code, is amended— in subparagraph (C), by striking and at the end; in subparagraph (D), by striking and at the end; and by adding at the end the following: the timeliness of emergency response notification, including by reducing penalties for cases in which incidents are reported within 10 minutes of a suspected release; and advanced coordination with State, local, Tribal, and territorial governmental entities resulting in the relevant and timely use of existing public alert notification systems; and .
