Equipment procured to carry out the authority under section 1250(a) of the National Defense Authorization Act for Fiscal Year 2016 ( Public Law 114–92 ; 129 Stat. 1068) may only be treated as stocks of the Department of Defense if the equipment procured— has not yet been transferred to the Government of Ukraine and is no longer needed to support a program carried out pursuant to such section; or has been transferred to the Government of Ukraine and has been returned by Ukraine to the United States. The Secretary of Defense may not transfer back into stock equipment described in subsection
(a)until the date that is 15 days after the date on which the Secretary of Defense submits a notification to Congress describing how the conditions of such subsection were met.
