Sec. 1564. Limitation on modification of certain electromagnetic spectrum relied on by Department of Defense

Section 488 of title 10, United States Code, is amended by adding at the end the following new subsection: Until the earlier of September 30, 2034, or the date on which the Chairman of the Joint Chiefs of Staff certifies to the congressional defense committees that dynamic spectrum sharing (as defined in the Emerging Mid-Band Radar Spectrum Sharing (EMBRSS) Feasibility Assessment Report of the Department of Defense published in September 2023) is fully operational, the Secretary of Defense may not modify any existing or future applicable system between 3100 and 3450 megahertz and between 7400 and 8400 megahertz unless the Secretary and the Chairman of the Joint Chiefs of Staff jointly certify to Congress that such modification would not result in a loss of capability for the armed forces.
In this subsection, the term applicable system means a Department of Defense system that relies on the electromagnetic spectrum for its function, including any communications, weapons, precision munitions, sensor, geo-location, or wireless device. .
