Sec. 1033. Support for counterdrug activities and activities to counter transnational organized crime

Subsection
(h)of section 284 of title 10, United States Code, is amended— in paragraph (1)— by redesignating subparagraphs
(A)and
(B)as subparagraphs
(B)and (C), respectively; and by inserting before subparagraph (B), as redesignated by subparagraph
(A)of this paragraph, the following new subparagraph: In the case of support for a purpose described in subsection (b)— the agency to which support is provided; the budget, implementation timeline with milestones, anticipated delivery schedule for support, and completion date for the purpose or project for which support is provided; the source and planned expenditure of funds provided for the project or purpose; a description of the arrangements, if any, for the sustainment of the project or purpose and the source of funds to support sustainment of the capabilities and performance outcomes achieved using such support, if applicable; a description of the objectives for the project or purpose and evaluation framework to be used to develop capability and performance metrics associated with operational outcomes for the recipient; information, including the amount, type, and purpose, about the support provided the agency during the three fiscal years preceding the fiscal year for which the support covered by the notice is provided under this section with respect to— this section; counterdrug activities authorized by section 1033 of the National Defense Authorization Act for Fiscal Year 1998 ( Public Law 105–85 ; 111 Stat. 1811); or any other significant program, account, or activity for the provision of security assistance that the Secretary of Defense and the Secretary of State consider appropriate. ; and in paragraph (3)(B)(i), by striking the Committees on Armed Services of the Senate and House of Representatives and inserting the congressional defense committees . Such section is further amended— by redesignating subsection
(i)as subsection (j); and by inserting after subsection
(h)the following new subsection: No support for the counterdrug activities or activities to counter transnational organized crime of any other department or agency of the Federal Government or of any State, local, tribal, or foreign law enforcement agency may be provided under this section for the detention of an individual at a military installation, Department of Defense facility, or Department of Defense-funded facility unless the Secretary of Defense independently verifies the nexus to drug activities or transnational organized crime prior to the transfer of such individual to such installation or facility. .
