Sec. 838. Late submission of cost and pricing data as invalid defense to contract price reductions for defective cost or pricing data

Section 3706(c) of title 10, United States Code, is amended— in paragraph (3), by striking ; or and inserting a semicolon; in paragraph (4), by striking the period and inserting ; or ; and by adding at the end of the following: the cost or pricing data were obtained by or otherwise made available to the prime contractor or subcontractor more than 30 days before, but submitted to the head of the agency after, the date of agreement on the price of the contract or, if applicable consistent with subsection (a)(2), such other date agreed upon between the parties. .
