Of the funds authorized to be appropriated by this Act or otherwise made available for fiscal year 2026 for Operation and Maintenance, Defense-Wide, to the Office of the Under Secretary of Defense for Policy and the Office of the Under Secretary of Defense for Acquisition and Sustainment, not more than 50 percent may be obligated or expended until the date on which the Secretary of Defense notifies the congressional defense committees that the Department of Defense has— updated all applicable regulations, polices, and departmental guidance to reflect the establishment of the Office of the Assistant Secretary of Defense for Nuclear Deterrence, Chemical, and Biological Defense Policy and Programs; and realigned personnel, facilities, and budgetary resources to reflect the implementation of section 138(b)(4) of title 10, United States Code.
