Sec. 1226. Acceptance back into stock of equipment procured under Ukraine Security Assistance Initiative

Section 1250 of the National Defense Authorization Act for Fiscal Year 2016 ( Public Law 114–92 ; 129 Stat. 1068) is amended by adding at the end the following new subsection: Equipment procured to carry out this authority pursuant to subsection
(a)may only be treated as stocks of the Department of Defense if— the equipment procured has not yet been transferred to the Government of Ukraine and is no longer needed to support a program carried out pursuant to such subsection; or the equipment procured has been transferred to the Government of Ukraine and is returned by Ukraine to the United States. The Secretary may not transfer back into stock equipment described in paragraph
(1)until the date that is 15 days after the date on which the Secretary submits a notification to Congress describing how the conditions of such paragraph were met. .
