Sec. 1056. Department of Defense sensitive activities

Chapter 3 of title 10, United States Code, is amended by inserting after section 130f the following new section: The Secretary of Defense shall keep the congressional defense committees fully and currently informed of Department of Defense sensitive activities. The Secretary of Defense shall submit to the congressional defense committees notice in writing of a compromise or failure of any Department of Defense sensitive activity not later than 48 hours following the compromise or failure. The Secretary of Defense, in coordination with the congressional defense committees, shall establish and submit to such committees procedures for complying with the requirements of subsection
(a)and
(b)consistent with the national security of the United States and the protection of operational integrity. The Secretary shall promptly notify the congressional defense committees in writing of any changes to such procedures at least 14 days prior to the adoption of any such changes. In this section, the term sensitive activity means operations, actions, activities, or programs that, if compromised, could have enduring adverse effects on United States foreign policy, Department of Defense activities, or military operations, or cause significant embarrassment to the United States, United States allies, or the Department of Defense. . Consistent with section 867 of the Servicemember Quality of Life Improvement and National Defense Authorization Act for Fiscal Year 2025 ( Public Law 118–159 ; 10 U.S.C. note prec. 4601), the Secretary of Defense shall establish a process for coordinating and deconflicting contracts of the Department of Defense that support or enable sensitive activities with other departments and agencies of the Federal government, as appropriate.
