Section 709 of the Foreign Intelligence Surveillance Act of 1978 ( 50 U.S.C. 1881h ) is amended— in the heading, by striking and inserting unauthorized disclosure ; unauthorized disclosure and other actions in subsection (a)— by striking if that person knowingly and inserting the following: if that person— knowingly ; by striking party. and inserting party; ; and by adding at the end the following new paragraphs: while serving as an employee or officer of the Federal Bureau of Investigation, knowingly and willfully violates the querying procedures adopted under section 702(f)(1)(A) relating to United States person queries; or knowingly and willfully falsifies or materially misrepresents complying with the procedures or requirements for querying information acquired under section 702(a). ; and in subsection (b)— by striking offense in this section and inserting the following: offense— in paragraph
(1)of subsection
(a); by striking title 18 and inserting title 18, United States Code ; by striking both. and inserting both; and ; and by adding at the end the following new paragraph: in paragraph
(2)or
(3)of subsection (a), shall be fined under title 18, United States Code, imprisoned for not more than 5 years, or both. . The table of contents at the beginning of such Act is amended by striking the item relating to section 709 and inserting the following new item: Sec. 709. Penalties for unauthorized disclosure and other actions. .
