Chapter 5 of title I of the Trade Act of 1974 ( 19 U.S.C. 2191 et seq. ) is amended by adding at the end the following: On and after the date of the enactment of this section, the President may impose a duty on the importation of articles into the United States under any provision of law, including a provision of law specified in subsection (b), only if— the President submits to Congress a proposal to impose the duty that includes a rationale for imposing the duty; and there is enacted into law a joint resolution approving the imposition of the duty.
The provisions of law specified in this subsection are the following: This Act. The Tariff Act of 1930 ( 19 U.S.C. 1301 et seq. ). The Trade Expansion Act of 1962 ( 19 U.S.C. 1862 et seq. ). The Trading with the Enemy Act ( 50 U.S.C. 4301 et seq. ). The International Emergency Economic Powers Act ( 50 U.S.C. 1701 et seq. ). Any provision of law enacted to implement a trade agreement to which the United States is a party. Any provision of a trade agreement to which the United States is a party.
Any other provision of the customs and trade laws of the United States (as defined in section 2 of the Trade Facilitation and Trade Enforcement Act of 2015 ( 19 U.S.C. 4301 )). Subsection
(a)does not apply to the exclusion of all articles, or all of a certain type of article, imported from a country from entering the United States. .
