Sec. 1658. Limitation on authority to reduce sustainment for or halt operation of the AN/FPS–108 COBRA DANE radar

Until the date on which the certification described in subsection
(b)is submitted to the congressional defense committees, the Secretary of Defense— may not reduce sustainment efforts for, halt operation of, or prepare to reduce sustainment efforts for or halt operation of, the AN/FPS–108 COBRA DANE radar located at Eareckson Air Station on Shemya Island, Alaska; shall sustain the AN/FPS–108 COBRA DANE radar in a manner that preserves, at a minimum, the operational availability of the system as of the date of the enactment of this section; and shall ensure that the AN/FPS–108 COBRA DANE radar continues to meet the operational requirements of the combatant commands that are met by such system as of the date of the enactment of this section. The certification described in this subsection is a written certification from the Secretary of Defense, in consultation with the Chief of Space Operations and the Director of the Missile Defense Agency, indicating that the replacement capability for the AN/FPS–108 COBRA DANE radar— will reach initial operational capability at the same time or before the termination of operations for the AN/FPS–108 COBRA DANE radar; and at the time such replacement capability achieves initial operational capability, will have the ability to meet the operational requirements of the combatant commands that have been, or that are expected to be, assigned to such replacement capability. The limitation described in subsection
(a)shall not apply to temporary interruptions of operational availability for the AN/FPS–108 COBRA DANE radar provided such activities are necessary to support maintenance or modernization activities of the system.
