Sec. 303. Authority to retract offers and contracts relating to deferred resignations

Any offer or contract relating to deferred resignation commitment accepted or entered into by an employee in a position in the civil service may be nullified by the employee (without penalty) at any time until the close of business on the last day of the employment of the employee by the agency employing the employee. A violation of subsection
(a)may be appealed to the Merit Systems Protection Board in accordance with the procedures under section 7701 of title 5, United States Code, or challenged in a court of competent jurisdiction.
