If any provision of this Act, or the application of such provision to any person or circumstance, is held to be invalid, the remainder of this Act, and the application of the remaining provisions to any person or circumstance, shall not be affected. If a court of competent jurisdiction enters a final judgment holding invalid or unenforceable a provision of this Act and supersedes regulations prescribed to carry out section 4, the Secretary may, notwithstanding any other provision of this Act, reissue or reinstate, in whole or in part, any similar regulations that were in effect on the day before the date of the enactment of this Act.
