Not later than 180 days after the date of enactment of this Act, the Secretary shall establish a program to provide grants and technical assistance to State regulatory authorities (as defined in section 3 of the Public Utility Regulatory Policies Act of 1978 ( 16 U.S.C. 2602 )) and nonregulated electric utilities (as defined in that section) considering the standard established by paragraph
(22)of section 111(d) of that Act ( 16 U.S.C. 2621(d) ) to assist in the creation of appropriate rate classes to ensure that costs relating to the energy demands of data centers, including costs of generation, transmission, and distribution network upgrades, are not borne or subsidized by customers that are not data centers. There are authorized to be appropriated such sums as are necessary to carry out this section.
