Section 3(c)(11) of the Federal Insecticide, Fungicide, and Rodenticide Act ( 7 U.S.C. 136a(c)(11) ) is amended— in subparagraph (B)— by striking The Administrator shall and inserting the following: The Administrator shall ; and by adding at the end the following: The Secretary of Agriculture shall include the Director of the Office of Pest Management Policy in all meetings of the interagency working group. ; in subparagraph (D)— in clause (iv)— by striking every 180 days thereafter and inserting each year thereafter ; and by striking during the 5-year period beginning on that date ; and by adding at the end the following:
All reports required under this subparagraph shall be published on the website of the Environmental Protection Agency. ; and by amending subparagraph
(E)to read as follows: In carrying out the duties under this paragraph, the working group shall, as appropriate— consult, including through public meetings, with representatives of interested industry stakeholders and nongovernmental organizations not less than once every year; and take into consideration factors, such as actual and potential differences in interest between, and the views of, those stakeholders and organizations. Before the Administrator implements any policy, strategy, workplan, or pilot program regarding the application of the Endangered Species Act of 1973 ( 16 U.S.C. 1531 et seq. ) to the processes for the registration or registration review of a pesticide under this Act, the Administrator shall— consult with the covered agencies on the policy, strategy, workplan, or pilot program and take into consideration input received; and publish the input received from the covered agencies in the docket with the corresponding policy, strategy, workplan, or pilot program. .
