Section 1861(eee)(2)(A)(ii) of the Social Security Act ( 42 U.S.C. 1395x(eee)(2)(A)(ii) ) is amended by inserting (including, with respect to items and services furnished through audio and video real-time communications technology (excluding audio-only) on or after January 31, 2026, and before January 1, 2028, in the home of an individual who is an outpatient of the hospital) after outpatient basis . Notwithstanding any other provision of law, the Secretary of Health and Human Services may implement the amendment made by subsection
(a)by program instruction or otherwise.
