For purposes of compelling compliance with the terms of this Act and the Agreement, the United States waives its sovereign immunity to the extent provided by Federal law. Nothing in this Act establishes any standard for the quantification or litigation of Federal reserved water rights or any other Indian water claims of any other Indian Tribe in any other judicial or administrative proceeding. Nothing in this Act quantifies or diminishes the water rights, claims, or entitlements to water of any other Indian Tribe, band, or community other than Agua Caliente.
This Act shall not be construed as establishing the taxing authority of any other Indian Tribe, other than Agua Caliente, or preempting the taxing authority of any other water district, agency, State, or local government. In the event of a conflict between the Agreement and this Act, this Act shall control. Nothing in this Act affects any provision of law (including regulations) in effect on the day before the date of enactment of this Act with respect to pre-enforcement review of any Federal environmental enforcement action.
